This Note will consider the legal position of commercial banks in the restructuring of foreign debt, not in the context of their rights and obligations vis-à-vis the sovereign, but vis-à-vis each other. It will identify and consider the legal and practical problems commercial banks encounter, and the circumstances under which conflicts may arise. Where possible, mechanisms by which such problems may be resolved will be suggested.
